Welcome to InstantGradient. By accessing or using our website at https://instantgradient.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site.

1. Use of Services

InstantGradient provides tools for creating and customizing gradient backgrounds and designs. You may use our services for lawful purposes only.

You agree not to:

  • Use the Site for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the Site or servers
  • Use automated systems to access the Site without an authorized API key (see Section 12)
  • Systematically scrape, download, or mirror the content of the Site or its databases

2. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, and software, is the property of InstantGradient or its licensors and is protected by copyright and other intellectual property laws.

The gradients you create using our tools are yours to use. You retain all rights to the images and designs you generate.

3. User Content

When you upload images or create content using our tools, you retain ownership of your content. We do not claim any rights to your uploaded images or generated designs.

4. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Site will be uninterrupted or error-free
  • Defects will be corrected
  • The Site is free of viruses or harmful components
  • The results of using the Site will meet your requirements

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTANTGRADIENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

6. Payment and Refunds

Some features of our Site may require payment. All fees are in USD and are non-refundable unless otherwise stated.

We reserve the right to change our pricing at any time. Price changes will not affect existing subscriptions until renewal.

7. Privacy

Your use of the Site is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.

8. Termination

We reserve the right to terminate or suspend your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" above. Your continued use of the Site after any changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which InstantGradient operates, without regard to its conflict of law provisions.

11. Community Content

When you save palettes, create collections, or set up a public profile on InstantGradient, your content may be displayed publicly on the Site, in the palette directory, on color pages, and through the API.

Palettes are shared community resources. When a palette is saved or exported, it is published to the public library and becomes available to all users of the Site and API. Color combinations are not copyrightable, and you do not acquire exclusive rights over a palette by saving it. You are free to use the gradients you generate in any project (personal, commercial, client work) without restriction.

By creating a public profile, you grant InstantGradient a worldwide, royalty-free, non-exclusive license to display your profile information (display name, bio, avatar, links) alongside the palettes you have saved, on the Site and through the API.

You may make your profile private at any time (Pro feature). A private profile hides your identity from palette pages, the directory, and the API, but does not remove the palettes themselves. Published palettes remain available to the community regardless of your profile visibility.

Unsaving a palette removes your personal save, but does not delete the palette from the public library. Palettes that have been saved by other users or enriched with metadata remain available. Deleting your account removes your profile and personal saves, but published palettes persist as community content.

12. API Terms of Use

The InstantGradient API ("API") provides programmatic access to palette generation, color data, and the community palette library. By creating an API key or making API requests, you agree to the following additional terms.

12.1 Access and Authentication

API access requires an active Pro subscription and a valid API key. Each Pro account is limited to one active API key. API keys are personal and may not be shared, transferred, sold, or published. You are responsible for all activity under your key. If you believe your key has been compromised, revoke it immediately in your dashboard.

12.2 Rate Limits

API usage is subject to daily credit limits as described in the API documentation. We may change rate limits at any time. Attempting to circumvent rate limits (through multiple accounts, key rotation abuse, request flooding, or any other means) is a violation of these Terms and grounds for immediate termination of your API access and account.

12.3 Attribution

Any application, website, or service that displays data obtained through the InstantGradient API must include visible attribution reading "Powered by InstantGradient" (or substantially similar) with a clickable hyperlink to https://instantgradient.com?utm_source=api&utm_medium=attribution. The UTM parameters must be preserved so we can track API-sourced traffic. This attribution must be visible to end users in any interface where API data is displayed. Removing, obscuring, or omitting the attribution link is a violation of these Terms.

12.4 Prohibited Uses

You may not use the API to:

  • Build a competing color palette or gradient generator service
  • Systematically download or mirror the color or palette database
  • Train machine learning models on the data without written permission
  • Resell, sublicense, or redistribute API access or API data to third parties
  • Remove, obscure, or alter attribution requirements
  • Use the API in a way that degrades the service for other users
  • Access the API after your subscription has expired or been terminated

12.5 Data and Availability

API data (palette names, color descriptions, tags, statistics) is provided as-is and may change or be removed at any time without notice. We do not guarantee any specific uptime, response time, or availability for the API. The API is provided on a best-effort basis.

12.6 Changes and Versioning

We may add, modify, or remove API endpoints at any time. For breaking changes to existing endpoints, we will make reasonable efforts to provide advance notice through the API documentation or email. Non-breaking changes (new fields, new endpoints) may be introduced without notice.

12.7 Termination and Revocation

We reserve the right to revoke any API key, restrict API access, or terminate your account at any time, with or without notice, for any violation of these Terms, suspected abuse, or any other reason at our sole discretion. Upon termination of your Pro subscription, API access ceases immediately. Your API key is not deleted but will return an error until you resubscribe.
